 What's included in the Mechanics Liens Registry? 

This Registry permits the registration of a Claim of Lien against real property for work done or to be done, or materials placed or provided or to be placed or provided on a particular property.

A claim for lien may be registered before or during the performance of the contract or of the subcontract or within 30 days after the completion or abandonment of the contract or subcontract.

A claim of lien may also be registered for any of the following:

  • Materials provided or placed
  • For services
  • For wages

A claim for lien must state

  • the full name and address for service of the person claiming the lien
  • the full name of the owner or whom the lien claimant believes to be the owner of the property for whom the work was or is to be done, or materials placed or provided
  • the time within which the work was or is to be done or the materials placed or provided
  • a short description of the work to be done
  • a description of the land (address/location/building description)
  • the sum claimed as due or to become due

Attached to the claim of lien is an affidavit of the person claiming the lien stating that he/she has personal knowledge of the matters to be verified.

All associated documents relating to the original Claim of Lien are also registered in the Registry of Mechanic’s Liens. These documents include:

  • Amendments to a Claim of Lien
  • Certificate of Action
  • Discharge of Lien
  • Vacate Order

Claims of Liens or any associated documents filed after March 20, 2006 are in digital format and may be viewed online.

CLAIM OF LIEN ON A CHATTEL

A claim of lien on a chattel CANNOT BE registered in the Mechanic’s Lien Registry. A person who has bestowed money, skill or materials upon a chattel or thing in the alteration or improvement of its properties or for the purpose of imparting an additional value to it, so as a result to be entitled to a lien upon the chattel or thing for the amount or value of the money or skill and material bestowed, has, while the lien exists but not afterwards in case the amount to which he or she is entitled remains unpaid for 3 months after it ought to have been paid, the right, in addition to another remedy to which he or she may be entitled, to sell by auction the chattel or thing on giving 1 week's notice by advertisement in the Gazette and in a newspaper circulating in the place in which the work was done, setting out the name of the person indebted, the amount of the debt, a description of the chattel or thing to be sold, the time and place of sale, and the name of the auctioneer, and leaving a similar written notice at the last known place of residence of the owner.

Summer Hours: 8:30 a.m. to 4:00 p.m.
